1.Introduction


Bringing Smiles Foundation (BSF) is a non-profit charity organization dedicated to providing comprehensive care and wholesome support to vulnerable children and sexual assault survivors.

These Terms and Conditions govern your relationship with BSF, including your rights and obligations as a member, volunteer, donor, or partner


Term: Compliance with the terms and conditions stipulated here in shall commence upon confirmation of membership and continue in full force until the withdrawal of a member or their termination from this non-profit organization.


2.Membership


2.1 Eligibility: Membership in the Bringing Smiles Foundation is open to individuals who are 18 years of age or older and who agree to abide by these Terms and the Foundation's Constitution.


2.2 Responsibilities of Members: Members agree to:

•Comply with the Law: Strictly comply with the laws of Kenya, particularly those related to the protection of vulnerable children as outlined in the Children's Act of 2022 and the supreme law of the land, The Constitution of Kenya 2010.

•Respect the Constitution: Adhere to the Bringing Smiles Foundation Constitution, including provisions regarding membership, financial diligence through monthly contributions, data protection, commitment to programs and projects, and respectful relationships with other members.

•Ethical Conduct: Maintain ethical behavior in all activities related to the Foundation. Any conduct deemed unethical, including but not limited to harassment, discrimination, or abuse of power, will result in termination of membership.

•Data Confidentiality: Respect the confidentiality of all protected data, including personal information of members and children supported by the Foundation. Any breach of confidentiality will result in termination of membership.


2.3 Termination of Membership: The Bringing Smiles Foundation reserves the right to terminate your membership at any time for any reason, including, but not limited to, violation of these Terms, the Foundation's Constitution, or Kenyan law.


Including:


•Engaging in unethical conduct or misconduct.

•Breaching confidentiality of protected data.

•Failing to comply with the Law of Kenya or the Bringing Smiles Foundation Constitution.

•Disrupting the harmony or safety of the organization or its beneficiaries

•Inactivity as a member of the organization without the provision of any reasonable cause.


2.4 Voluntary Termination: Voluntary withdrawal can be initiated by sending an email to termination@bringingsmilesfoundation.org so that one can be removed from our official records. Expect an official confirmation within 5 business days.


3.Volunteering


3.1 All volunteers must abide by these Terms and Conditions and BSF's volunteer policies.


3.2 Volunteers must complete necessary training and background checks as required by BSF.


3.3 Volunteers agree to act responsibly and professionally while representing BSF.


4.Donations


4.1 Donation Types: Bringing Smiles Foundation accepts various forms of donations, including:


•Monetary contributions via designated channels as stipulated in the organization’s website.

•In-kind donations of child-friendly items in good condition delivered to the designated drop-off location.


4.2 Donated Goods: Donated goods must be appropriate for the children the foundation supports and in good condition.


Unless otherwise specified, all donations of child-friendly items must be dropped off at BSF's designated location.


Bringing Smiles Foundation reserves the right to choose the donations which shall be given to the children we support, based on the state of the item donated.


5.Partnerships


5.1 Collaboration: Bringing Smiles Foundation welcomes potential partners who share its mission and values.

 

5.2 Partnership Procedures: All inquiries regarding partnerships should be directed through the contact details provided on the website, where relevant information and policies are outlined.


5.3 Ethical Considerations: Bringing Smiles Foundation expects all partners to uphold the highest ethical standards and comply with relevant laws and regulations.


6.Confidentiality


6.1 Data Protection: Bringing Smiles Foundation is committed to protecting the confidentiality of all personal data, including member and beneficiary information. Please refer to BSF's Privacy Policy for further information on data collection, use, and disclosure


6.2 Data Security: The organization implements appropriate technical and organizational measures to safeguard data against unauthorized access, disclosure, alteration, or destruction.


6.3 Confidentiality Breach: Any breach of confidentiality, whether intentional or unintentional, will be investigated and may result in disciplinary action, including termination of membership or partnership.


7.Intellectual Property


7.1 Copyright: All content on the Bringing Smiles Foundation website, including text, images, and logos, is protected by copyright. You may not copy, distribute, modify, or use any content without the express written permission of the Foundation


8.Governing Law and Dispute Resolution


8.1 These Terms and Conditions shall be governed by and construed in accordance with the laws of Kenya.


8.2 Any dispute arising from these Terms and Conditions shall be settled through amicable discussion or mediation.

 

9.Amendments


9.1 The Bringing Smiles Foundation reserves the right to amend these Terms at any time. You are responsible for regularly reviewing these Terms to ensure that you are aware of any changes.


9.2 Your continued use of BSF's website and services after posting signifies your acceptance of the amended Terms and Conditions.
